Mr K was involved in an accident at work whilst delivering incorrectly loaded and packaged stock to a supermarket, resulting in soft tissue injuries to his lower back.
At the initial Trial the District Judge found against Mr K and dismissed his claim.
ASD disagreed with the District Judge’s findings and advised Mr K to appeal the Court’s decision. Mr K agreed and the matter went before the appeal Circuit Judge, who after listening to legal argument from both sides overturned the District Judge’s initial findings and upheld the Claimant’s claim, awarding the Claimant compensation as a result of the successful appeal.
