Case Summary

Grace Newbold, solicitor for ASD, represented a local driver involved in a road traffic accident on 26/09/2021. In this case study, she explained how she assisted the client during the process and the challenges she faced. 

The Incident and Initial Challenge

I arranged an immediate home visit and obtained full details. I was able to assist the client on a ‘no win no fee’ basis. While the injuries were not immediately life-threatening, they quickly began to impact my Client’s everyday life. 

The Defendant’s insurer admitted liability early in the process. However, the initial response was sluggish, and a key point of friction arose when the defendant failed to make a necessary interim payment to my Client.

Strategy and Key Actions

  1. Enforcing the Interim Payment: When the defendant failed to pay the agreed interim amount, I took immediate action and issued formal court proceedings. The pressure of the issued proceedings forced the Defendant’s compliance, and the interim payment was secured, providing Client with financial relief.
  1. Comprehensive Medical and Rehabilitation Management:  My Client had multiple injuries, both physical and psychological. In order to properly assess for medico-legal purposes and in respect of treatment, a number of different experts were instructed to prepare reports.
    1. Orthopaedic expert 
    2. Rheumatologist 
    3. Chartered and Clinical Psychologist.

15 sessions of Cognitive Behavioural Therapy (CBT) were funded by ASD for my Client.

  1. Case building: Gathering all relevant medical evidence required to demonstrate my Client’s injuries, alongside evidence in respect of the treatment she underwent, a detailed schedule of losses was drafted. 
  1. The Outcome

In July 2025, I successfully secured a significant settlement for the Claimant.

Conclusion

This case demonstrates that an admission of liability doesn’t always guarantee a smooth process. Grace’s proactive approach—including the readiness to issue proceedings to enforce a necessary interim payment—was paramount in moving this claim forward. Further, the availability of additional expert evidence, even in so-called ‘low value’ cases, enabled the case to be correctly valued. Almost all firms use GP reports in low-value cases, whereas we can utilise an orthopaedic surgeon.
