Mrs M of Rotherham, was incorrectly advised by her Union that she was unable to claim for serious injuries sustained when she was struck by a uninsured driver.

Mrs M was on holiday in Cleethorpes, walking along a footpath, when an uninsured driver mounted the kerb and struck her. Unfortunately the Claimant’s friend was killed and she sustained a serious foot and head injury as well as psychological damage. The person who had caused the accident was arrested and subsequently jailed for causing death by dangerous driving. The vehicle had been stolen and had no insurance attached to it.

After receiving negative advice from her Union Mrs M instructed Richard Meggitt, Solicitor at ASD. He advised that it was appropriate to make an application to the Motors Insurers Bureau who compensates the victims of uninsured and untraced drivers. They are funded insurance premiums not by the Government. Medical evidence was put in place and treatment in the form of Cognitive Behavioural Therapy was arranged through a private provider. Mrs M was extremely traumatised by the accident, however her symptoms were mitigated by the therapy received.

ASD eventually secured compensation of £105,000 from the MIB.
