Mr W sustained a significant shoulder injury after being knocked over by a refuge lorry while riding his bicycle.
Richard Meggitt, Solicitor for ASD dealt the case with the assistance of Chris Chappell, Solicitor. The insurers for the refuge lorry initially denied liability. Responsibility was only accepted after the commencement of Court proceedings.
Mr W sustained a tear to his rotator cuff leaving him with a permanent disability. It was a tribute to Mr W’s fortitude that he was able to return to work after about 9 months. He did, however, recover compensation for being handicapped on the open labour market should he lose his job at any stage in the future. The award included compensation for pain, suffering and loss of amenity, past and future care provided by his wife, treatment, past loss of earnings, a lump sum to reflect his handicap on the open labour market, and interest.
Mr W was pleased to bring the litigation to a successful conclusion without a formal hearing.
