Richard Meggitt, Solicitor in the Serious Injury Team at ASD, acted for a child in Rotherham who sustained a serious brain injury.

The child was struck by a car when he was returning home from school. He was taken to Sheffield Children’s Hospital by ambulance and was an inpatient for a number of weeks.

The insurers for the motorist continued to deny liability until less than a month before a trial to determine who was a fault. Although the client sustained a significant brain injury he was able to continue in mainstream school. The neuro-surgeon instructed by ASD was of the opinion that it would not be possible to determine the effect of the injury upon the child’s employment until he had reached the age of 16. Numerous other experts were instructed including a child orthopaedic surgeon, plastic surgeon, psychiatrist, care and occupational therapist and ENT surgeon,

9 years after taking initial instructions the value of the claim was agreed, on a 100% liability basis, with the insurers at Joint Settlement Meeting. The agreement was at just over £2.5 million. Richard Meggitt, in addition to acting for the child in the personal injury claim, was also appointed as a Deputy to look after his financial interests.

It is unlikely that the client will ever secure paid employed and he will undoubtedly continue to rely upon his family and professional carers for assistance.
