Mr W, from Sheffield, suffered Post Traumatic Stress Disorder when a cherry picker that he was operating partially collapsed.
Although the insurers for Mr W’s employer admitted breach of duty they did not accept that any psychological injury had been caused. Mr W suffered from might mares and flashbacks as a result of the incident and was unable to work for approximately one year. He was not physically injured. A low offer was made by the insurers which resulted in Court proceedings being necessary. After many months of litigation the insurers eventually accepted an offer that the client had previously made.
Mr W made a good recovery after receiving cognitive behavioural therapy paid for by the insurance company.
