Miss S of Retford, Notts, secured significant damages following a motorcycling accident. Miss S was riding pillion in an accident in which the rider of the motorbike was killed. The motorbike struck a car at high speed after the vehicle had emerged from a minor road.

Richard Meggitt, Solicitor for ASD dealt with Miss S claim throughout taking over from another firm of Solicitors who had done very little in the 2 years they were instructed. Miss S lost the use of her left arm as a result of a devastating brachial plexus injury. In addition the client had head, back and leg injuries. The insurers for both vehicles denied liability. After being instructed, court proceedings were issued against the insurers within a month. A trial to determine liability took place within 12 months of ASD being contacted by Miss S.

Rehabilitation was put in place and a very large interim payment was obtained following a court hearing, the insurers refused to make such a payment. The payment enabled Miss S to purchase a more suitable property for her and her young son. After a Joint Settlement Meeting agreement was reached with the motorist’s insurance company resulting a payment to compensate the client for her injuries, past loss of earnings, past care provided by her family and future care to allow professional assistance. In addition compensation was paid for past and future loss of earnings, a sum to enable her to purchase an automatic car rather than a manual, as well as payment for DIY and gardening that will have to be carried out by family members.

Richard Meggitt, part of the serious injury team at ASD said ‘no amount of money can ever compensate for the devastating injuries sustained by my client in this tragic accident, however the payment made by the insurance company will mean my client can continue her rehabilitation without financial worries’ Miss S is unlikely to ever return to full time employment. She will also require on going assistance for life.
